Bylaws
ARTICLE 2—Members
2.1. Categories of Membership.
There shall be three categories of membership: regular member, retired member
and associate member.
2.2. Regular Member.
Regular membership is extended to an individual who is employed by the
Mt. Diablo Unified School District either in a management or confidential
position and is responsible for administration, supervision or support services.
A Regular member shall have the vote and is eligible to serve as an officer,
director or committee member.
2.3. Retired Member.
Retired membership is extended to a former DMA member currently not employed
in the field of education, but receiving compensation from one of the state
retirement systems. Only a retired member holding the director position shall
have the vote, but all retired members are eligible to serve as committee
members or in the capacity of retired director.
2.4. Associate Member.
Associate membership is extended to individuals as determined by the Board.
Associate members are not entitled to vote but are eligible to serve as committee
members.
2.5. Member Obligation to Follow Association Rules.
Each member of this Association agrees to be bound by these Bylaws and any
amendments thereto, and by the lawful actions of the Board or voting members
of the Association, including the adoption of a code of ethics or standards.
2.6. Termination.
A membership shall be suspended or terminated whenever the Board, or a committee
or person authorized by the Board, in good faith determines that any of the
following events have occurred: (a) resignation of members, on reasonable
notice to the Association; (b) expiration of the period of membership, unless
the membership is renewed on the renewal terms fixed by the Board; (c) failure
of a member to pay dues, fees, or assessments in the amount and under the
terms set by the Board; and (d) occurrence of any event that renders a member
ineligible for membership, or failure to satisfy membership qualifications.
2.7. Discipline.
A member may be publicly reprimanded, fined, suspended or terminated for
cause by the Board or its designee. Cause shall include a significant abuse
of the authority conferred on a member or a failure, on serious degree, to
observe the Association's rules of conduct as prescribed in these Bylaws or
otherwise by the Board. The member shall be given a minimum 15-days prior
written notice of the proposed discipline with the reasons. The notice shall
also include the member's opportunity to be heard, orally or in writing, not
less than five days before the effective date of the discipline by the Board
or its designee. The Board or its designee shall determine whether cause exists
and the appropriate discipline, if any.
2.8. Member Liability.
No member of the Association shall be personally or otherwise liable for
any of the debts or obligations of the Association.
